1. AGREEMENT TO TERMS

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Services.

These Terms constitute a legally binding agreement between you and Thr3d Labs LLC regarding your use of the Services.

2. INTELLECTUAL PROPERTY

The Services and their original content, features, and functionality (excluding User Content as defined below, including 3D models submitted by users for printing) are owned by Thr3d Labs LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material obtained through the Services (other than your own User Content or 3D models you submit for printing), or delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Services.

The 3D models displayed on our Services for informational and educational purposes are provided as such. We do not claim ownership of these models, and we make no representations or warranties regarding their ownership or licensing status.

Regarding 3D models submitted by you for 3D printing services: You represent and warrant that you own or have all necessary rights, licenses, consents, and permissions to submit such models and to authorize us to use them for the purpose of fulfilling your printing order. You agree to indemnify and hold harmless Thr3d Labs LLC from any claims arising from an alleged infringement of third-party intellectual property rights related to the models you submit.

3. 3D PRINTING SERVICES

Ordering Process

To order a 3D print, you must submit a digital 3D model file through our designated portal. You are responsible for providing an accurate and printable 3D model in a supported file format. We may provide an estimated cost and timeline upon submission, but this is subject to change based on model complexity and material availability.

User-Submitted Models

By submitting a 3D model ("Your Model") for printing, you represent and warrant that:

• You are the creator and/or owner of Your Model, or you have obtained all necessary licenses, rights, consents, and permissions to submit Your Model and to grant us the rights to use it for the purpose of fulfilling your printing order.
• Your Model and its subsequent printing and use will not infringe upon or violate the intellectual property rights (including copyrights, patents, trademarks, trade secrets), privacy rights, publicity rights, or any other rights of any third party.
• Your Model does not contain any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable, nor does it depict or facilitate the creation of weapons, hazardous materials, or items that violate applicable laws.

You retain all ownership rights to Your Model. By submitting Your Model, you grant Thr3d Labs LLC a non-exclusive, royalty-free, worldwide license to use, reproduce, modify (e.g., for printability adjustments, scaling, support generation), and prepare derivative works of Your Model solely for the purpose of producing the physical 3D print as requested by you and for internal quality control and archival purposes related to your order.

We are not responsible for the functionality, accuracy, or integrity of Your Model. You are solely responsible for ensuring Your Model is designed appropriately for 3D printing and for its intended purpose. We may, at our discretion, attempt to identify and inform you of potential printability issues, but we are under no obligation to do so, nor are we liable if we fail to identify such issues.

Printing Process and Materials

We will use commercially reasonable efforts to produce 3D prints according to the specifications of your order and the characteristics of the selected materials. However, you acknowledge that 3D printing is an imperfect process and variations in color, texture, finish, dimensions, and material properties are inherent. We do not guarantee that the final print will be an exact match to digital renderings or previous prints.

Material selection is your responsibility. Information provided about materials is for guidance only, and we make no warranties regarding the suitability of any material for your specific application.

Pricing and Payment

Prices for 3D printing services will be quoted based on model complexity, material, and print time. Full payment is required before printing commences. [You may want to elaborate on this section with more specific details about your payment process.]

Order Rejection or Cancellation

We reserve the right to refuse or cancel any order at our sole discretion, at any time, for reasons including but not limited to: unsuitability of the model for printing, suspected intellectual property infringement, violation of our Prohibited Uses policy, or inability to source materials. If we cancel your order after payment, a full refund will be issued.

Quality and Acceptance

Our liability will be limited to reprinting the object or providing a refund, at our discretion. We are not responsible for damage occurring after successful delivery or due to misuse or improper handling.

4. DISPLAYED 3D CONTENT AND USER-GENERATED CONTENT

Our Displayed Content

The 3D models displayed on our Services (not including models submitted by users for printing) have been collected from various sources for informational and educational purposes. We do not claim ownership of these models, and we make no representations or warranties regarding their ownership or licensing status.

If you believe that any displayed content on our Services infringes your intellectual property rights, please contact us immediately at [email protected]. We will promptly investigate and remove any content that violates intellectual property rights.

User Uploads (Not for Printing Orders)

If the Services allow users to upload 3D models or other content for purposes other than placing a 3D printing order (e.g., for community sharing, display), the following terms apply:

• You retain all ownership rights to your uploaded content.
• By uploading such content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in connection with the Services (e.g., displaying it on the platform).
• You represent and warrant that you own or have the necessary rights to upload the content and grant us the license described above.
• You are solely responsible for ensuring that your uploaded content does not infringe upon the intellectual property rights of others.
• We reserve the right to remove any uploaded content that violates these Terms or that we determine, in our sole discretion, to be inappropriate or harmful.

5. USER ACCOUNTS

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Services.

You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar, or obscene.

6. PROHIBITED USES

You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm the Company or users of the Services or expose them to liability.
• To attempt to reverse engineer, decompile, or otherwise attempt to extract the source code of any 3D models or other content from our Services (excluding your own models submitted for printing).
• To use any automated system or software to extract data from our Services ("scraping") without our express written permission.
• To use the Services for any commercial purpose (other than as a customer of our 3D printing services) without our express written consent.
• To submit any 3D model for printing that:
  • Infringes on any third party's intellectual property rights.
  • Is intended to create, or could reasonably be used to create, firearms, weapons, ammunition, or components thereof.
  • Is illegal, obscene, defamatory, threatening, harassing, or otherwise objectionable.
  • Is designed for any unlawful purpose or to facilitate any illegal activity.
  • Could be harmful to individuals or public safety.

7. USER CONTENT

Our Services may allow you to store, share, or otherwise make available certain information, text, graphics, videos, or other material. You are responsible for the content that you post on or through the Services, including its legality, reliability, and appropriateness.

By posting content on or through the Services, you represent and warrant that:

• The content is yours and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms.
• That the posting of your content on or through the Services does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity.

8. TERMINATION

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Services.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. LIMITATION OF LIABILITY

In no event shall Thr3d Labs LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Services.
• Any conduct or content of any third party on the Services.
• Any content obtained from the Services.
• Unauthorized access, use, or alteration of your transmissions or content.
• With respect to our 3D printing services:
  • Any defects, errors, or unsuitability of the 3D models you submit for printing.
  • The structural integrity, performance, fitness for a particular purpose, or durability of any 3D printed object. You are solely responsible for determining the suitability of a printed object for its intended use.
  • Minor variations in color, finish, or dimensions inherent in the 3D printing process.
  • Any damage to printed objects after they have been successfully delivered to you.

Our total liability to you for any and all claims arising out of or relating to the 3D printing services shall not exceed the amount paid by you for the specific printing service giving rise to the claim.

10. DISCLAIMER

Your use of the Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Thr3d Labs LLC, its subsidiaries, affiliates, and its licensors do not warrant that:

• The Services will function uninterrupted, secure, or available at any particular time or location.
• Any errors or defects will be corrected.
• The Services are free of viruses or other harmful components.
• The results of using the Services will meet your requirements.

With respect to our 3D printing services:

• We make no warranties regarding the quality, accuracy, printability, or success of printing any 3D model submitted by you. The outcome of the 3D printing process is highly dependent on the quality and design of the submitted model.
• 3D printed objects are provided "AS IS" without any warranties as to their strength, durability, heat resistance, biocompatibility, or suitability for any particular use.
• We do not guarantee that printed objects will be free from minor cosmetic imperfections, such as layering lines or support marks, which are inherent to the FDM/FFF or other 3D printing processes used.
• Any information provided regarding materials or print settings is for informational purposes only and does not constitute a warranty of performance or outcome.

11. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.
